mySymphony Terms of Service

Welcome to mySymphony, a software-as-a-service (SaaS) platform that provides scheduling, billing, and business management tools for music staffs and studio owners. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and mySymphony, Inc. (“mySymphony,” “we,” “our,” or “us”) regarding your use of the Service.

By accessing or using our website, applications, or related services (collectively, the “Service”), you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

If you are entering this agreement on behalf of an organization, you represent and warrant that you have authority to bind that entity. In such cases, “you” refers to both the organization and its authorized users.

We may update these Terms from time to time. Material changes will be communicated via email or posted prominently on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

1. Account Terms

1.1 Eligibility

You must be at least thirteen (13) years old to create and use an account.

1.2 Account Registration

You must provide accurate and complete information, including your name and email address, during registration. You are responsible for keeping your information up to date.

1.3 Account Use

Each account is for a single user only; sharing logins among multiple users is prohibited. If your subscription supports team members, you may create separate logins for each authorized user.

1.4 Security

You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. mySymphony is not liable for any loss or damage arising from your failure to secure your account.

1.5 Free Accounts

Only one free account per individual or organization is allowed.

1.6 Prohibited Uses

You may not use the Service for unlawful purposes or violate any applicable laws, including intellectual property and privacy laws.

2. Subscription, Billing, and Payments

2.1 Subscription Plans

Access to premium features requires a paid subscription. Fees are billed in advance on a monthly or annual basis.

2.2 Automatic Renewal

Subscriptions renew automatically unless canceled before the renewal date.

2.3 Price Changes

We may change pricing with thirty (30) days’ prior notice by email or through the Service.

2.4 Refund Policy

All fees are non-refundable. No credits are given for partial months or unused features.

2.5 Taxes

You are responsible for any applicable taxes, except those based on our income.

3. Cancellation and Termination

3.1 User Cancellation

You may cancel your subscription at any time through your account settings. All data will be permanently deleted upon cancellation.

3.2 Termination by mySymphony

We may suspend or terminate your account for violations of these Terms or misuse of the Service, with or without prior notice.

3.3 Effect of Termination

Upon termination, all rights and licenses granted to you under these Terms will immediately cease.

4. Modifications to the Service

We may modify or discontinue any part of the Service at any time, with or without notice. We are not responsible for any loss or damage resulting from such changes.

5. Intellectual Property

5.1 Ownership

All intellectual property in the Service, including software, design, and trademarks, belongs to mySymphony or its licensors.

5.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

5.3 User Content

You retain ownership of any content you upload but grant us a limited license to use it for operating the Service.

6. Privacy and Data Protection

6.1 Privacy Policy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

6.2 GDPR Compliance

If you are in the European Economic Area, you have rights under the General Data Protection Regulation (GDPR), including access, correction, and deletion of your personal data.

7. Acceptable Use

Violation may result in suspension or termination of your account.

8. Mobile Applications

If you access the Service via an iOS or Android app:

8.1 Apple Users

You acknowledge these Terms are between you and mySymphony, not Apple. Apple is not responsible for the Service or its content.

8.2 Google Users

You acknowledge these Terms are between you and mySymphony, not Google. Google has no responsibility for the Service or support.

9. Disclaimers and Limitation of Liability

  • The Service is provided “as is” and “as available,” without warranties of any kind.
  • To the maximum extent permitted by law, mySymphony shall not be liable for indirect, incidental, orconsequential damages.

10. Dispute Resolution and Arbitration

10.1 Arbitration

All disputes shall be resolved by binding arbitration under United States law. You waive your right to a jury trial or to participate in class actions.

10.2 Exceptions

You may bring claims in small claims court or seek injunctive relief for intellectual property violations.

11. General Provisions

  • These Terms constitute the entire agreement between you and mySymphony.
  • Failure to enforce any provision does not waive our rights.
  • These Terms are governed by the laws of United States.
